1. Acceptance of Terms

By accessing or using Fabiana ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Fabiana provides a multi-tenant conversational AI platform that enables businesses to deploy AI-powered conversational agents across messaging channels, manage customer relationships, and automate conversations. The Service includes agent configuration, conversation management, CRM functionality, analytics, and related features.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.

4. Subscription and Payment

The Service is offered on a subscription basis. Fees are billed in advance on a monthly or annual basis and are non-refundable except as required by law. We may change our fees with 30 days' notice. Your continued use after a fee change constitutes acceptance.

5. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited messages, or engage in phishing
• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Distribute malware or harmful code
• Attempt to gain unauthorized access to the Service or other accounts
• Use the Service for any illegal or fraudulent purpose

6. Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy. You retain ownership of your data. We process your data only as necessary to provide the Service and as directed by you.

7. Third-Party Services

The Service integrates with third-party platforms (e.g., WhatsApp, OpenAI, Stripe). We are not responsible for the availability or terms of these third-party services. Your use of third-party services is subject to their respective terms.

8. Limitation of Liability

To the maximum extent permitted by law, Fabiana shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

9. Termination

You may cancel your subscription at any time. We may suspend or terminate your account for violation of these terms or for non-payment. Upon termination, your access to the Service will cease and your data may be deleted after a 30-day grace period.
